As a participant in the Disability:IN conference (“Attendee”) and/or Exhibitor at the Disability:IN conference, Attendee and/or Exhibitor hereby agrees to be bound to following terms and conditions as necessary for participation in the 2024 Disability:IN Global Conference and Expo (“Conference”), unless, being a part of the Federal Government, Attendee or Exhibitor is bound, otherwise, by federal law:

  • FEES, PAYMENTS, CANCELLATIONS
    • All monies paid by Attendees and Exhibitors shall be deemed full earned and non-refundable at the time of payment.
    • In the event you are no longer able to attend the conference in-person and paid for an in-person registration you have two options:
      • You may send a colleague from your company in your place. Please email Abbey Hunter at: ahunter@QandAEvents.com with your confirmation number, along with the name and email address of the individual you will be sending to the conference. 
      • If you pay via credit card or check, you may convert your in-person registration to a virtual registration. In this event, your one (1) in-person registration will be converted into three (3) virtual registrations for you to share with colleagues at your company.
    • If you use a comp code to register for the conference, you may transfer your registration to a colleague or convert your one (1) in-person registration to one (1) virtual registration. 
    • There is a “no cancellation” policy for all virtual registrations, and there are no full refunds of in-person registrations.
    • After May 31, 2024, in-person registrations can no longer be converted to virtual, you will still be able to transfer your in-person registration to a colleague. 
    • Online payments may be made by credit card.  For other payment options, please reach out to: accounting@disabilityin.org. 
    • Disability:IN may cancel the Conference for any reason at its sole discretion. If the Conference is cancelled for any reason, registrants will be given the opportunity to request a refund, use the paid funds to cover registration for the 2025 Conference, or donate the funds to Disability:IN outright.
    • No Attendee or Exhibitor shall be allowed to participate within the Conference unless it has paid to the Conference the total amount of all sums owed, in clear funds at least one month in advance of the Conference start date. 
  • EVENT PRIVACY POLICY
    • To demonstrate our commitment to the privacy of your information, we have developed this policy, which discloses our privacy practices for the information we collect through this Registration Website as part of Conference Registration. It is understood that the any information provided by Attendee is done for the purpose of registering for the Conference and to facilitate Attendee’s participation in the Conference, including through the sharing of necessary information from us, the Conference host, and with others, as described below.
    • To receive necessary Disability:IN information (E-Newsletter, Announcements, etc.), Attendee is required to complete this registration form. This registration form will request certain personal information about the Website user. This information will be compiled into a profile. Such information may include at least the following: name, address, email address, company name, phone number, work address.
    • Disability:IN takes the privacy of Attendee’s information very seriously. Attendee controls any information we may share with third parties by opting-in as a part of the registration process. Disability:IN will never share Attendee’s information without express consent. Disability:IN will only use Attendees’ information for Conference purposes. Disability:IN will employ substantially similar protections to protect unauthorized disclosure of any information that it uses to protect its own information. 
    • Attendees can update personal information by choosing to modify the registration form. 
    • I hereby irrevocably permit, authorize, and license Disability:IN and its legal representatives, successors, licensees, agents, assigns, and those acting on Disability:IN’s behalf ("Authorized Persons") to use, re-use, publish, and re-publish any images, photographs, video, either separately or together and either in whole or in part, and all materials created by or on behalf of the Authorized Persons that incorporate any of the foregoing ("Materials") for advertising, promotion, and other commercial and business purposes and in any medium, format, or platform now existing or hereafter created without further consent from or any royalty, payment, or other compensation to me. I specifically consent to the use of the Images with other images, text, graphics, film, audio, and audiovisual works. I acknowledge and agree that the Images may be altered or modified without any restrictions, whether by traditional photographic techniques or digitally, including retouching, creating composite, blurred, or distorted representations, and changing color, size, shape, perspective, context, foreground, or background.
  • VIOLATIONS 
    • The Attendee shall be bound by the rules as defined herein, and by such additional rules and regulations which may be established by Disability:IN at any time. Q&A events shall enforce all rules and such additional rules and regulations, and its decision on these matters will be final. All matters and questions not covered by the rules and such additional rules and regulations shall be subject to the final judgment and decision of Disability:IN. Any violation by the Attendee of any of the rules and such additional rules and regulations shall subject Attendee to cancellation of the agreement to occupy the exhibit space, to forfeiture of any monies paid on account thereof, and could make Attendee subject to loss of seniority points, loss of credentials for future shows and loss of other show privileges. Upon Disability:IN notifying Attendee of such cancellation, Disability:IN shall have the right to take possession of the Attendee’s space.
  • TERM CHANGES
    • Disability:IN may amend or change these terms and conditions at any time without any prior notice. Disability:IN will inform Attendees of any changes. Any Attendee who provides any information after changes to this Privacy Policy are posted will be deemed to have accepted the revised Privacy Policy. If at any point Disability:IN decide to use the information you provided through this Website in a manner different from that stated at the time it was collected, Disability:IN will send an email notifying Attendees  of such changes and offering  the option to allow or not allow us to use the information in the different way. Without such consent, Disability:IN will use information in accordance with the Privacy Policy in effect at the time the information was collected.
  • ACCESSIBILITY/REQUESTS FOR ACCOMMODATION
    • Disability:IN understands and values the importance of accessibility and uses good faith efforts to make the Conference accessible to all.
    • Disability:IN is not responsible for and does not evaluate the accessibility of any physical spaces outside of its designated Conference area.  Disability:IN further does not provide any accommodations or disability-related support to Attendees outside of these services that may be provided within its designated Conference area and/or at an official Conference event or presentation.  This includes but is not limited to informal networking or social events created by Attendees before, during or after the Conference. Any external links provided during the course of the Conference do not constitute an endorsement by Disability:IN of the opinions, products or services presented on the external site, of any sites linked to it, or Attendee materials. 
    • Access to and use of any websites or mobile apps linked to or referenced during the conference or any materials distributed by Disability:IN during the conference shall be subject to the terms of the applicable Terms of Use and Privacy Policy made available on such websites.  In addition, the conference and associated Disability:IN websites may link to other websites provided for the convenience of the users.  The contents of these websites are maintained by their owners, for which Disability:IN takes no responsibility, including but not limited to their accessibility or usability.  Neither can responsibility be taken for contents of any website linking to these websites.  
  • REQUESTS FOR ACCOMMODATION
    • Disability:IN provides the following accommodations, available to all Attendees during regular Conference hours within the premises of the Conference:
      • CART
      • ASL interpreters on a first come, first serve basis
      • Insert any already being provided services
    • Any Attendees requesting any additional accommodations to be provided during regular Conference hours within the premises of the Conference must do so in writing no later than fourteen (14) days before the Conference start. Requests for accommodation received after the request for additional accommodation deadline will be considered and evaluated as practicable.
    • Requests for additional accommodations should be directed to: Conference@disabilityin.org
  • INDEMNIFICATION
    • Attendee agrees to indemnify and hold Disability:IN, its partners, affiliates, vendors, subcontractors, officers, employees, and agents harmless from any and all losses, liabilities, damages and/or costs (including reasonable attorneys' fees) arising from any and all, including third-party, claims arising from or related to Attendee’s use of any website, their participation in the Conference, cyber security breach, or any other activities related to Attendee’s participation in the Conference.
  • LIMITATIONS ON INSURANCE AND LIABILITY
    • Neither Disability:IN, nor any of the officers, employees, agents, contractors and affiliates of such entities, nor the owners, management company, employees or representatives will be responsible for any injury, loss or damage that may occur to the Attendee or to the Attendee’s employees or property  or to any third parties, prior, during or subsequent to the period covered by the virtual exhibit. Attendees are responsible for all liability insurance coverages in line with industry standards.
    • Recommendations given and views expressed by third-party speakers, sponsors and/or exhibitors are their own and Disability:IN in no way endorses or guarantees such recommendations or views.  Disability:IN shall have no liability for any advice given, or views expressed, by any third-party speaker, sponsor and/or exhibitor at the conference or in any material provided to attendees that is prepared by third parties.  YOU EXPRESSLY UNDERSTAND AND AGREE THAT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR ATTENDANCE AT THE CONFERENCE IS AT YOUR SOLE RISK, AND THE CONFERENCE AND ALL INFORMATION AND MATERIALS ARE PROVIDED “AS-IS” AND WITHOUT WARRANTY OF ANY KIND. FURTHER, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DISABILITY:IN OR ITS CONFERENCE ORGANIZERS BE LIABLE FOR ANY LOST PROFITS, LOST OPPORTUNITY, LOST SAVINGS, LOSS OF GOODWILL, LOST BUSINESS, LOSS OF ANTICIPATED BENEFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES ARISING OUT OF OR AS A RESULT OF THESE TERMS & CONDITIONS, THE CONFERENCE OR ANY INFORMATION OR MATERIALS PRESENTED OR MADE AVAILABLE DURING THE CONFERENCE, EVEN IF DISABILITY:IN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS WILL APPLY WHETHER AN ACTION IS IN CONTRACT OR TORT AND REGARDLESS OF THE THEORY OF LIABILITY.
  • COVID-19 POLICY
    • Attendee agrees to adhere to all Centers for Disease Control and Prevention guidelines in effect as of the date of the Conference.  
    • Attendee agrees to adhere to all COVID-19 policies implemented by the hotel hosting the Conference, in effect as of the date of the Conference.  
    • Attendee certifies that attendee is fully compliant with all COVID-19 policies implemented by Attendee’s employer in effect as of the date of the Conference. 
    • Participation in the Conference (including any related travel) carries with it certain inherent risks related to COVID-19 transmission (“Inherent Risks”) that cannot be eliminated regardless of the care taken to avoid such risks.  Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying COVID-19; (2) the risk of transmitting or contracting COVID-19, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from COVID-19 or the treatment thereof.  
    • Disability:IN and the facility hosting the Conference have undertaken reasonable steps to lessen the risk of transmission of COVID-19 in connection with the Conference, Disability:IN is not responsible in any manner for any Inherent Risks.
    • Attendee hereby agrees to release Disability:IN and its past, current, and future officers, directors, employees, members, volunteers, contractors, representatives, parents, owners, affiliates, agents, successors, and assigns from any and all damages, injuries, losses, liability, claims, causes of action, litigation, or demands,  including but not limited to those involving Inherent Risks, personal injury, sickness, or death, as well as property damages and expenses, of any nature whatsoever which may be incurred, directly or indirectly, now or in the future, in any way related to COVID-19 and in connection with my participation in the Conference or any travel related thereto.
    • Attendee agrees to carefully review and, during the event and all event-related activities, follow all COVID-19 protocols in place at the time of the Conference as directed and/or recommended by the State of Florida and local law.
    • Attendee understands and agrees that Disability:IN will continue to closely monitor conditions related to COVID-19 between now and the start of the conference and that Disability:IN reserves the right to modify its COVID-19 related procedures and health screening protocols at its sole discretion at any time. Registrants will be informed of any such changes on an ongoing basis. As a condition of attendance and participation, attendees agree to follow the protocols as required by Disability:IN.  Refusal to abide by Disability:IN’s COVID-19 related procedures may result in removal from the conference and cancellation of attendee’s registration.
  • EXHIBITOR OPERATION AND CONDUCT
  • Accessibility
    • All Exhibitors agree to comply with Title III of the Americans with Disabilities Act (ADA) and each Exhibitor’s virtual display  must be accessible to persons with disabilities. Exhibitor agrees that it is solely responsible for ensuring that its virtual booth and display fully complies with the ADA.   Additionally, Exhibitor agrees that:
      • Any electronic documents must include alt text on any images and meet the guidelines of WCAG 2.2, Level A and AA (“WCAG 2.2”)
      • Any printed documents/handouts must be made available in Braille and Large Print formats.
      • Any PowerPoint Presentations must be made available via electronic format and meet the guidelines of WCAG 2.2, including but not limited to providing alt text for any images.
      • Any videos must have Closed Caption and Audio Description 
      • It will be Disability:IN’s sole decision if any portion of the booth is deemed not usable based on accessibility standards to reject the booth from inclusion at the Conference or to require specific modifications be made.
  • Exhibit Personnel
    • Exhibitor and other employees or representatives of Exhibitor must confine their activities to their exhibit space.
    • Disability:IN encourages booths (virtually or in-person) to be staffed during all show hours in order to maximize attendee engagement. 
    • Exhibitor may not harass or antagonize another party or attendee.
    • No area of the Conference platform or site shall be used for any improper, immoral, illegal or objectionable purpose.
    • All in-person and on-camera Exhibitor's personnel and their contractors must wear appropriate apparel at all times. Business or business casual attire is recommended. 
  • Entertainment, Music
    • All music and entertainment must be in good taste and not include any lyrics that are inflammatory, sexually explicit, sexist, violent or that promote activities of any type that defame or denigrate people with disabilities, women, LGBTQ+, law enforcement or other established authorities.  
    • It is the responsibility of the Exhibitor to ensure that any music or media used does not violate any third-party intellectual property rights. 
  • Booth Space
    • If on camera meetings will occur, the background of your camera view should be clean and professional. 
  • Indemnification

Exhibitor shall (i) defend and hold harmless Disability:IN from any filed and/or threatened third-party lawsuit arising from a claim that any booth, programming and/or content provided by Attendee violates the ADA and/or any applicable federal, state or local accessibility law because it or they are not accessible and/or do not conform to WCAG 2.2 (an “Eligible Claim”) (ii) pay any non-appealable final judgment arising from an Eligible Claim; or an amount agreed to, in writing, by Disability:IN to settle an Eligible Claim; and (iii) timely remediate the issues alleged in an Eligible Claim to the extent they do not meet the WCAG 2.2, Level A or AA

  •   ACCESS CONTROL
    • Disability:IN will provide access control from Conference planning through the conclusion of all activities, including follow-up. Disability:IN shall not be held responsible for the loss of any material by any cause and urges the Exhibitor to exercise normal precautions to protect its account and materials contained within.
  • COMPLIANCE WITH LAWS
    • Attendee agrees to comply with and be bound by all laws of the United States, and state and local laws applicable to the Conference venue, and wherever applicable, all rules and regulations of the police department and those policies and criteria established by the laws governing virtual or in-person environments. 
  • ENTIRE AGREEMENT
    • These Terms of Use and the other policies and terms set forth on this Website set forth the entire agreement between Attendee and Disability:IN on this subject matter and supersede all other negotiations, understandings, statements and agreements between Attendee and Disability:IN.
